The 2009 Great Kitchen Contest

Do you have a fabulous kitchen in Westchester? Enter Westchester Home magazine’s Great Kitchen Contest. We’ll be featuring the winners—the most elegant, functional, and beautiful kitchens—in our Winter 2010 issue.

Entries will be judged on the basis of the kitchen’s (1) use of new materials and appliances; (2) innovation in design choices; (3) overall impression; and (4) other factors the judges deem appropriate.

There are three methods for submitting your photos:

By Mail

All photographs or discs must be clearly labeled with your name, address, telephone number, and location of the home.
Westchester Home assumes no responsibility for lost or damaged entry materials. We cannot return photographs or discs. Photographs submitted will be considered publishable by Westchester Home. Entry must include written authorization from the photographer and any other copyright holder to use and publish the photographs.

Eligibility

While architects, builders, and interior designers may cooperate in the entry process, all entries must be submitted by homeowners, who alone are responsiblefor complying with these contest rules. Home must be an occupied residence in Westchester County. Homes that are for sale during the contest period are not eligible for consideration. The kitchen cannot have appeared in any regional or national publication. This includes print material; magazine, newspaper, advertisements, etc. Homeowners must be willing to be identified by name and town, to be available for an interview, and to sign a release authorizing publication and promotional use. Award-winning entries may not be published in any other publication without written consent from Westchester Home until June 1, 2010. Westchester Home may deem it necessary to commission photography in addition to what was submitted by the entrant. Award-winning kitchens must be available at a specified time for photography. Commissioned photographs of the award-winning kitchens are the sole property of Westchester Home.

Winners will be notified by November 23, 2009. Entrants agree to abide by these official rules. Westchester Home and their parents, subsidiaries, affiliates, and agents assume no liability for lost, misdirected, damaged, incomplete, incorrect, altered, illegible, or postage-due entries. By entering this contest, entrants release Westchester Home, its parent company, subsidiaries,
affiliates, and agents from any liability arising from participation in this contest.

2009 Great Kitchens Contest Submission Terms and Conditions
Westchester Magazine invites interested parties to submit digital photographs as part of the 2009 Great Kitchens Contest. WESTCHESTER MAGAZINE retains full editorial control over the selection of, and the decision not to select, any particular photograph for publication.

1. Technical Specifications

You must be 18 years of age or older to submit a photograph. If you are younger than 18 years and wish to submit a photograph, you may have your parent or legal guardian submit the photograph on your behalf; in that case, in the photo description the parent or guardian should note the photographer's name, age and relationship to the submitter. Submissions must be in JPEG (.jpg or .jpeg) digital format, at least 1,600 pixels wide if a horizontal image or 1,600 pixels tall if a vertical image, and no greater than 5 megabytes (5120 kilobytes) in file size. Please provide only the original, unmodified camera image. Westchester Magazine will consider no photographs that it identifies as obscene, provocative, or otherwise containing objectionable content; nor will we consider submissions from employees of Westchester Magazine or its subsidiaries, or family members of same.

2. Rights Granted

By submitting a photograph for consideration, you warrant and represent that the photograph you submit (the "Photograph") is your own original work (or, in the case of submitting on behalf of a child, the original work of your child), that you alone (or your child) own copyright to the Photograph, that it is an authentic and accurate depiction of the subject matter presented, that no other party has any right, title, claim or interest in the Photograph, and that you have obtained all third party releases and permissions necessary for our use. If Westchester Magazine receives a complaint that substantially questions the reliability of any of the above warranties, we reserve the right to remove or delete the Photograph.

You grant to Westchester Magazine and its subsidiaries and licensees ("WESTCHESTER MAGAZINE") the following rights: a royalty-free, worldwide, perpetual license to display, distribute, reproduce and create derivatives of the Photograph, in whole or in part, without further review or participation from you, in any medium now existing or subsequently developed, in editorial, commercial, promotional and trade uses in connection with WESTCHESTER MAGAZINE Products. A WESTCHESTER MAGAZINE Product is defined as "a product of WESTCHESTER MAGAZINE, a corporate subsidiary, affiliate, joint venturer or licensee of WESTCHESTER MAGAZINE, in any language, which is associated with a WESTCHESTER MAGAZINE trademark and over which WESTCHESTER MAGAZINE has Editorial Control." For the purposes of this Agreement, "Editorial Control" means the right to review, consult regarding, formulate standards for, or to exercise a veto over the appearance, text, use, or promotion of the product. This license includes the nonexclusive right to make the Photograph available to third parties (i) for library or other research uses through microfiche, microfilm, or any other archival storage and retrieval form, including but not limited to electronic databases and document delivery services; and (ii) for distribution in connection with an WESTCHESTER MAGAZINE press conference or press release.

3. Upon request you will provide the following releases.

To qualify for inclusion in Westchester Magazine, you must comply with the following additional requirements: In the event original works of art owned by third parties appear in the Photograph, you must be prepared to provide an Artist Release signed by the third party copyright holder. In the event recognizable people appear in your Photograph, you must be prepared to provide the Personal Release signed by those people, authorizing our publication of the Photograph. In the event the Photograph is taken on private property, you must be prepared to provide the Location Release signed by the owners of the property, authorizing our publication of the Photograph.
